Proposed Ordinance No. 477

A proposed zoning ordinance and zoning map, which will repeal and replace, in its entirety, the current zoning ordinance and zoning map, Chapter 27 of the Township Code of Ordinances, Ordinance No. 360, adopted on November 23, 2004.

Project Overview

In 2020, North Fayette Township entered into a services agreement with Herbert, Rowland, and Grubic, Inc. (HRG) to conduct a full and comprehensive update to the Township’s existing Zoning Ordinance. The Township Board of Supervisors appointed staff from the Department of Community Development, two Planning Commission members, and several Township residents, developers, and property owners to serve on the Zoning Ordinance Update Steering Committee. 

The Steering Committee met monthly, a mix of in-person and Zoom meetings, from June 2020 through February 2021, to discuss various key issues, topic areas, etc. Edits, revisions, changes, and additions were made to the draft ordinance throughout this planning process and as discussed at various meetings with the Steering Committee and Township staff. 

The Draft Zoning Ordinance is currently under review and pending recommendation by the Township Planning Commission at its upcoming meeting on April 1st at 7:00pm. The presentation made to the Planning Commission at its March 4th meeting introducing the proposed ordinance can be found here.

In addition, the Board of Supervisors is set to hold a public hearing on April 26th at 6:00pm. The Township looks forward to any public comments and feedback on the draft Zoning Ordinance.

Draft Zoning Ordinance & Zoning Map 

The Zoning Ordinance Update involved a comprehensive review and analysis of many components of the Ordinance. Additional terms/definitions were added, some terms/definitions were deleted, and other terms/definitions were changed or updated slightly. Many of the new definitions added are land use terms and any new uses terms defined in the Ordinance were also added to the Table of Authorized Principal Uses. If a new term/definition was added as a conditional use, then specific conditional use criteria for that land use term was also added to the Ordinance. Other changes made include the addition of an accessory uses and structures table and updated Area and Bulk tables for residential districts, non-residential districts, and PRDs. The parking requirements table was also updated to account for terms added or removed. 

Another change made was that language was added regarding accessory dwelling units and tiny homes and where they are allowed. Also, several updates were made to the PRD regulations in regard to pedestrian gathering areas, pet pockets, and HOAs. There was language added in District Regulations regarding the protection of trees and woodlands and the requirement for certain amenities to be included in new developments, such as bicycle racks and appropriate dumpster screening methods. The Signage Article was also updated. 

In regard to the Township’s proposed Zoning Map, several changes were made. The residential districts were consolidated from five (5) to two (2), the Village and Town Center Districts were removed, and Mixed Use District was added. The PNRD Overlay, PRD Overlay, and Road Overlay Districts were removed from the map. PNRD and PRD are uses now allowed within certain districts but are no longer considered overlays. A Streetscape Enhancement Overlay District was added throughout the Pointe at North Fayette and RIDC Park West areas and near the Five Points Intersection.
